According to ISNA, in these days when the enemy is trying to divert the youth from the path of religion through cyberspace and cultural activities, mosques are the best place to attract the youth and implement programs to counter the enemy’s actions.
For this reason, mosques that have high capacity to attract young people should be equipped day by day. One of these mosques that has cultural, sports, recreational and even economic capacities is “Ansar Al-Mahdi Mosque” in Tehran, located in North Janatabad area; A mosque that was built many years ago with the efforts of the people of this area and with a lot of effort to solve some of the concerns of the residents of this neighborhood, especially for the cultural and religious activities of children and teenagers.
This mosque was able to finish a major part of its building in the 90s. The distinguishing point of this mosque from other mosques of Tehran province is in the sources of income of this mosque. And on the other hand, the shortages of the neighborhood should be provided for the establishment of various jobs and to meet the needs of the people. However, the final and very important part of this mosque, which is related to sports and cultural centers, especially for children and teenagers, has remained half-finished since 2016, despite the provision of all the equipment related to the construction and completion of the project.
According to the locals, one of the other parts of this mosque that has been used a lot by the locals was the mosque clinic. According to the builders of this mosque, they took a lot of effort to get permits for this clinic and also to provide its equipment, but this clinic has been destroyed. And its location has been rented to a restaurant, and ISNA’s follow-up about who gave permission to destroy the clinic and change its use to a restaurant did not reach any results!
According to the condition of this mosque and several calls from the residents of the mosque to the news agency, ISNA reporter followed up the issue to find out the reason why the projects of Ansarul Mahdi Mosque (AS) are incomplete. Investigations show that according to the law, any mosque that has raqabat (referred to property and land that is given to someone to benefit from it for life) or endowments must coordinate with the endowment and charity organization so that all its raqbats and endowments The mosque should be legally registered. Also, an endowment trustee should be considered for these sources of income so that the resulting resources are spent in the right direction and for the same mosque.
It is mandatory to register competitors of mosques in the endowment organization system
For this purpose, in order to better clarify the rules related to mosques that have competitors and endowments, we sat down with Hojjatul Islam Mohammad Nowrozpour – Director General of Bekaa Mutbarkeh and Religious Places Organization of Endowments and Charitable Affairs – to learn more about the framework of this issue.
Hojjat-ul-Islam Noroozpur said about the mosques that have rivals: the mosque is originally an endowment, when it is decided that a place will be used as a mosque, that place is considered a waqf, and for that, it finds the current waqf form and the ruling of the mosque, in Meanwhile, some mosques have endowments and competitors through which the costs of the mosque are covered. Based on this, the buildings that are built or even added to the mosque after its construction, are endowed by the waqfs or their guardians to the mosque so that the current costs of the mosque are covered from its income. Here, we have a system in the general administrations of endowments and charity affairs, in which these competitors must be registered.
He continued: The procedure is that the waqif or the residents of that mosque should go to the General Department of Awqaf and Charitable Affairs in their place and announce the details of the competitors. Then, the endowment letter related to those rivals is issued and referred to the office so that those rivals, in addition to the awqaf and charitable affairs organization, are also registered and recorded as competitors of that mosque in the system of the document registration organization. This is because the competitors are not registered in the name of a specific person and in this way its resources are reserved for the mosque. Unfortunately, we had cases where people came and created endowments and competitions, but they did not register the documents in the Endowments and Charities Organization and the organization, and it remained in the names of individuals and caused problems. We have had cases where the heirs of the trustees approached and claimed ownership of the land of a mosque or hosseiniyeh and requested to reclaim the property.
The General Director of Endowments and Religious Places of the Awqaf Organization stated that in order to preserve and protect endowments and endowments throughout history, they must be registered as endowments, and noted: We have a system in the Endowment and Charity Organization called “Comprehensive Endowment and Beqaa System.” We have a deed written in it. Of course, in addition to this system, the endowment organization sends a letter to the official office to register the endowment, which is done for two reasons, firstly, that the accurate and official registration of the endowment takes place, and secondly, that the new document can be amended accordingly, because it is possible that a property A mosque or Hosseinieh is built in it, or competitors such as a property or a shop are also added to it. In this situation, all competitors and new documents will remain throughout history.
Hojjat-ul-Islam Nowrozpour also expressed about the way of using the endowments and rival funds: the use of the resources of these endowments and rivals is in two ways, on the one hand, the waqif can specify for the mosque and its rivals that the trustee has the duty to revive the rivals and In these cases, the Organization of Endowments and Charitable Affairs issues a guardianship order for the mentioned person. On the other hand, it is possible that the waqf has not specified a trustee for a mosque, hosseiniyya or religious place and has left it at the disposal of the endowment organization, in which case the endowment organization chooses one person from among the people, believers and believers as the trustee of the endowment. According to the law, one of the duties of the endowment organization is to appoint a trustee or a board of trustees to manage the affairs of religious facilities, and all religious places, including Imamzadegan, Bekaa Motbaraka, mosques, etc., are the same.
He reminded: Apart from this law in Tehran province, according to the memorandum signed between the Organization of Endowments and Charitable Affairs and the Mosque Affairs Center, it was decided that the imam of each mosque should identify the board of trustees and introduce them to the mosque affairs center. And the decision of the Board of Trustees to be the center for dealing with the affairs of mosques, and for managing the affairs of competitors, the imam of the congregation should be introduced to the endowment organization as a trustee, and we will also make the decision.
The Director General of Bekaa Motbaraka and Religious Places of the Awqaf Organization also emphasized about how the competition’s income is spent for the mosque: Based on the form that we proposed regarding the trustee of the endowment, every mosque should have a two-signature account with one of the country’s banks, with one signature for the imam. Jamaat and two signatures for the members of the board of trustees, of course, in this situation, the board of trustees can also choose a financial manager.
Hojjat-ul-Islam Nowrozpour clarified: Of course, mosques whose endowments have a specific trustee can open an account in one of the country’s banks and manage the affairs of competitors, but endowments that do not have a financial manager or a specific trustee must have their financial circulation and accounts in the “Comprehensive System” In fact, the tenants of the endowments put their money into the mosque account, which is registered in the endowment organization system, in this situation, the check is removed from the banking relationship and the work is done by remittance.
In the end, he said: “We in the “Comprehensive Endowment and Bekaa Motabaraka System” know about the financial turnover of the mosques’ competitors, and in this way we can find out how much income each mosque earns and where this income is spent, and the documents of the expenses are sent to the General Department of Endowments of the neighborhood. After sending and confirming there, it can be issued in the form of money order and can be cashed from the bank. In this situation, if there is any violation, the Awqaf organization will monitor it. Of course, anyone who observes a violation can refer to the inspection department of the Awqaf and Charitable Affairs Organization and announce the violation, and we are also the authority to handle the violation.
Contradiction regarding the status of competitors of Ansar al-Mahdi Grand Mosque (AS)
According to what was mentioned in this conversation, a mosque must have a trustee or an endowment trustee, and based on a bank account whose information is recorded in the “Comprehensive endowment and blessing system”, the financial circulation and expenses are determined. to be However, ISNA news agency’s investigation of the former board of trustees of Ansar al-Mahdi Mosque (AS) shows that this mosque does not currently have a board of trustees. Also, the imam of the mosque has not been the trustee or trustee of the endowment in different periods.
In order to clarify the truth of this claim, we went to the mosque affairs center, and the legal office of this center does not currently have a manager, and no response was received, but after following up with one of the former managers of this center, we found out that someone from the mosque affairs center He is present in this mosque as an endowment trustee.
Of course, by inquiring with the office of the “Comprehensive Endowment and Blessed Endowment System” of the Awqaf Organization, we found out that Ansar Al-Mahdi Mosque (AS) is only registered as an endowment in this system, and there is no information about its competitors.
However, by referring to the General Directorate of Awqaf North-West of Tehran Province, different and of course contradictory information was obtained. Hojjat-ul-Islam Mehdi Zainaldini – head of endowments in the northwest of Tehran province – said in an interview with ISNA about the competitors of this mosque: the competitors of this mosque have been announced to us for several years and they have been registered in the “Comprehensive Endowment and Beqaa Matbaraka System” and even The auctions related to these competitors are also held in the General Directorate of North-West Endowments.
